at long long last..
I have been cleared and case thrown out..
regarding the time in february when I wa sDuty manager of a certain retial store..and I held the liquer wines spirits licence..
meaning that a woman aged 47 sold alcohol to a trading standards test..and it was i under aged customer-test.
I was told I WAS RESPONSIBLE as the store manager that day..and therefore would be fined £5k..and lose the licence..blah blah blah..making me feel like a darn criminal..
i wa seven suspened..gr..
Now I have argued via solicitors and usdaw union that I did NOt sell any alcohol to an under age person..I was in the wages office doing wages.
I may have been the manager when inicident happened...but If I had been on the checkout myself..no way woukld I have sold any alcohol to a person that age..
(In fact records show in the log book for age related sales that my name was in there 37 times noting I had checked for peoples ID...also that I refused several people ...and the cctv shows I wa sNOT on the shop floor that time..
The fact I have had an outstanding CRB check (criminal records) and good work history and references and loads and loads of supporting letters from staff at that store plus the big big other retail store I was also Duty manager in..
along with care home good reorts..as a responsible person..
all went in my favour..and the case has been discharged..the court has refunded the £120 I already paid off the fine and all cleared off.(Well I aint got it back cos the solicitor bill was £160 an hour!!!) so i will pay it off that hugey bill.
My name is cleared and I got a phone call...just now saying case dismissed.
Phw this has been 10long long months.
Sadly the retial store concerned is up in court for a big big big fine eek..and the 47 year old lass who served the person fined £80 with it on her records.
I just hope therei s NO big turn-around when it all goes to court again early 2009..but I have been told..I am not needed.Phweeeeeeeeee

Even though the law states that th manager on duty is responsible for all alcohol sales..and id therefore giving their permission to the staff to sell age related sales..the court has at last seen..it the way we all have..
I DID NOT SERVE ANY CUSTOMER THAT DAY>and the Trading standards has said well in fairness I was not even on the shop floor..but normally that makes no odds..I am responsible for any actions by staff...
daft laws..but this wa sone nice judge I finks.I just did not fancy the long drive back up North....to court..but thankfully my solicitor sent a rep.
Huh..great big bill but well worth it

Must be a whole load off your mind and the criminal record should now be quashed 'cos you is INNOCENT!!!!!!
Hahahaaaaaaaaaaaaaaaaa at Timmy wanting to party LOL!
I know it is a big bill for all your legal fees but it is money well spent to get rid of all that trash.
Just wish Mr David was here to see this............on second thoughts David will know!
