Nope, because the documents do not exist for any US citizen. Or do you have a certified copy of an oath of allegiance? If you do please show it to me because I got a million bucks waiting that says you don´t have such a thing.
Or, if Ruby is right, a legal statement to the effect that there are no such documents. That would end the lawsuit. Simple. A few bucks of legal expense.
Nope, he would have to go to court and prove it, but I think the judge has common sense and can digress without any statements that such documents don´t exist...even you and I know that...since we are both Americans and neither of us possess any of those type of documents.
But there's now more than one lawsuit. First, by failing to respond to Berg's suit the law actually says that Obama has admitted to the claim. I know, a technicality but that's what the law says. And now a second lawsuit has been filed in the Supreme Court of Hawaii demanding that Obama's birth records be released. Given that he's got no expectation in law of privacy in this matter in any case (and the fact that he's posted something on his own website says that he's waived any that might exist) it'll be interesting to see what arguments he comes up with to block access to those records.
actually he did respond in requesting that the lawsuit be dismissed remember? Also, there is no right to public record on birth certificates in Hawaii regardless so yes he can have an expectation of privacy...and given that he has a US passport the burden is yours to prove that he obtained the passport by fraud...not his.
This has actually turned up on legal discussion boards - the lawyers are wading in big time and quoting chapter and verse of the law. And they're all wondering who's arms he's going to twist and how he's going to block things this time.
