Order
 
On defendant's, Barack Hussein Obama and the democratic national committee's motion to dismiss plaintiff's complaint pursuant to rule 12(b)(1) and 12(b)(6)
 
This cause came before the United States District Court Judge, Honorable R. Barclay Surrick on Defendant's Barack Hussein Obama and the Democratic National Committee's Motion to Dismiss.  Having Reviewed the Motion and Plaintiff's Opposition to said Motion and for good cause shown, it is hereby 
 
Ordered that the Motion to Dismiss pursuant to F.R.C.P. 12(b)(1) and 12(b)(6) is Denied.  It is Further Order of this court that the following discovery is to be turned over to Plaintiff within three (3) days:
 
  1. Obama's "vault" version (certified copy of his "original" long version) Birth Certificate; and
  2. A Certified copy of Obama's Oath of Allegiance.

It Is So Ordered.

We keep coming back to why the DNC is spending a small fortune on this when a fifty dollar notarial fee will solve the problem.  Or, if Ruby is right, a legal statement to the effect that there are no such documents.  That would end the lawsuit.  Simple.  A few bucks of legal expense.
 
But there's now more than one lawsuit.  First, by failing to respond to Berg's suit the law actually says that Obama has admitted to the claim.  I know, a technicality but that's what the law says.  And now a second lawsuit has been filed in the Supreme Court of Hawaii demanding that Obama's birth records be released.  Given that he's got no expectation in law of privacy in this matter in any case (and the fact that he's posted something on his own website says that he's waived any that might exist) it'll be interesting to see what arguments he comes up with to block access to those records.
 
This has actually turned up on legal discussion boards - the lawyers are wading in big time and quoting chapter and verse of the law.  And they're all wondering who's arms he's going to twist and how he's going to block things this time.

Nope, because the documents do not exist for any US citizen.  Or do you have a certified copy of an oath of allegiance?  If you do please show it to me because I got a million bucks waiting that says  you don´t have such a thing.

Nope, he would have to go to court and prove it, but I think the judge has common sense and can digress without any statements that such documents don´t exist...even you and I know that...since we are both Americans and neither of us possess any of those type of documents.

actually he did respond in requesting that the lawsuit be dismissed remember?  Also, there is no right to public record on birth certificates in Hawaii regardless so yes he can have an expectation of privacy...and given that he has a US passport the burden is yours to prove that he obtained the passport by fraud...not his.

By not responding as a point of law he's technically admitted all the claims.
 
As noted there has been a lawsuit filed in the Hawaiian Supreme Court demanding the documents be released.  [Coincidentally that was filed an hour before he announced he had to go to Hawaii to visit his grandmother.]  That lawsuit says, among other things, that by posting a copy of the certificate registering his birth he's waived any right to privacy on this one.
 
There is a third lawsuit in Washington demanding that, if Obama can't prove he's a citizen, he be removed from the ballot [expect a lot more like this].

To be filed in the Hawaiian supreme court it would need to be rejected in the lower courts...so do you have a link? Because evidently that means the lawsuit by Berg was dismissed.

Summer, fact is he did not respond to the claims in the lawsuit.  He simply asked that it be dismissed.  Those are two different things.
 
And the suit in the Hawaiian Supreme Court was not filed by Berg, but by another individual.  It's not an appeal of Berg's decision but a completely separate claim (my understanding is that Berg is filing an appeal of his suit with the Supreme Court to ask for an emergency injunction).

and he will not get the emergency injunction because he has no standing. The Elections board would have to bring the suit...not an individual. The Elections board is charged with verifying people´s status and if they have an issue they disqualify you. He is qualified whether you like it or not.

I still don't understand why they are fighting so hard not to reveal the original birth certificate. One would think they would proudly display it. This fighting against revelation is what makes people suspicious. One would think that the issue has already been rewearched but there seems to be something fishy here.

For the record, Hawaiian officials have confirmed that they have the original type written birth certificate in their possession (so much for the "their isn't one" claim).  That seems to end the "Obama is a Kenyan wetback" theme. 
 
And it does bring us back to the question of why spend a small fortune blocking its release as opposed to a $50 notary fee?  Something does not compute.
 
Martin does have a hearing date set for November 18th - since he's not suing to deny Obama's eligibility but only to see the document this presents a completely different set of legal questions. 
 
Shame that Obama didn't take his own advice regarding the confirmation of Judge Roberts:
 
Let me also say that I remain distressed that the White House during this confirmation process, which overall went smoothly, failed to provide critical documents as part of the record that could have provided us with a better basis to make our judgment with respect to the nomination. This White House continues to stymie efforts on the part of the Senate to do its job. I hope with the next nominee who comes up for the Supreme Court that the White House recognizes that in fact it is its duty not just to the Senate but to the American people to make sure we can thoroughly and adequately evaluate the record of every single nominee who comes before us.

If he had done so, none of this would be going on.

Shiftless if they say they have the original why do you need to see it? Hawaiian officials say they possess an original document...so that should resolve your question about him being born in the US and being a natural born citizen.

xguuuunny  crrrrrrrrrreeeeeeeeeeeeeep- people like you are appalling. Funnily I had just spent part of the day debunking an antiobama email which porportedly had him in an interview on Meet the Press saying he hated the flag. He wasn't even on Meet the Press that day. People like you just hate and put down withut knowing anything about the person you are putting down.
 
If you actually are an exmarine one would think you would respect McCain's service and one would think you would want to protect this nation.
