Madeleine McCann case

PJ believes Kate killed her daughter

Madeleine may have been assaulted.

But she could also have died because of an accident, after having been sedated to sleep.

This is the Policia Judiciaria’s conviction, as they believe that Kate killed Maddie, either accidentally or in a conscious form.

There are no certainties, just clues that point to the child’s mother. For her behaviour, for the way she acted about her daughter’s disappearance, for the cadaver smells and forensic evidence that were collected by scientific police.

Kate presented herself at Policia Judiciaria on Thursday, visibly out of control. Police forces that were contacted by CM say she had several hysterical reactions during the more than 13 hours of interrogation. And she refused to answer many questions. She did not explain the blood that was found in the car, she did not answer whether she slapped her daughter in the face. And she didn’t even clearly confirm if she sedated the children.

Only the facts are certainties for the PJ. And those facts revealed it was Kate who usually took care of the children, putting them to bed regularly, while Gerry played tennis or rested by the pool. The deposition of the senior British citizen (Pamela Fenn), who occupied an apartment on the floor above the one that was used by the McCanns, also indicates that Kate sometimes became violent. She lost control, and it was easy to hear the girl’s screams, calling out for her father. Another witness, also a British citizen, refers the same scenario. Kate seemed to have moments of aggression towards her children, while the father, although more absent, revealed more emotional control.

Kate refuted all these suspicions at the Policia Judiciaria in Portimao, where she was interrogated, and it was then that the penal circumstances of negligent murder were explained to her. CM knows that the investigators, while not confronting her directly with a possible aggression, explained her that by not confessing to the accident, she could be opening the doors into a more serious penal setting.

Which means it would stop being treated as negligent homicide, and would pass into a qualified crime or with eventual harm.

Father asks PJ for evidence

Gerry also had an unusual behaviour during the judicial interrogation. When he was confronted with the PJ’s suspicions, Maddie’s father repeatedly asked for evidence to be presented to him. He did not promptly deny the facts, but was trying to assess whether the authorities had enough clues to support the homicide theory.

For PJ, there is another strange situation. If it was an accident, why did the McCanns get rid of the body and simulated an abduction? The possibility that they could be trying to hide something more than a thoughtless action is on the table, and investigators are just waiting to exhaust all the chances that they may explain the death themselves. After that, they will advance the formal murder charge, with hiding of the corpse.

Blood found 'was definitely Madeleine's'

THE international hunt for missing British girl Madeleine McCann took several new twists yesterday as the investigation appeared to focus more tightly on her parents.

Portuguese police moved closer to charging the parents Kate and Gerry McCann after demanding the mother's diary be seized as trial evidence.

Madeleine, 3, disappeared from a room in a Portuguese holiday resort in May while her parents dined at a nearby restaurant.

'Blood was definitely Maddie's'

Blood found in a car hired by her parents weeks after she disappeared definitely came from the British girl, it was reported yesterday.

The Portuguese newspaper Correio da Manha cited police sources as saying new tests on blood found in the hire car conclusively showed it was Madeleine's.

"The definitive result of the tests leave no doubts for the Policia Judiciaria. The blood found in the McCanns' car is that of Madeleine as well as those samples detected in the flat," the paper said.

Portuguese police have also reportedly cast doubt on evidence an expat Briton was spotted near the resort the night of the disappearance. They say Robert Murat, who has been questioned several times, maintains he was home on the night and that the man seen may have been a friend of the McCanns.

The McCanns - officially suspects in Portugal - reacted in fury to the claims.

Kate's diary 'points to her involvement'

Portuguese newspapers have already published what they claim are extracts from Kate's journal and say the diary is fundamental to the belief that the 39-year-old GP and mother-of-three was involved in the death of her daughter.

Passages are said to reveal a mother at her wits' end coping with three hysterical kids. Her twins, Sean and Amelie, were aged 2 when their sister vanished. Cardiologist Gerry, 39, is said to be portrayed as an absent dad happy to leave his wife to shoulder the burden while he relaxed on holiday.

Unsourced claims in the Portuguese media said police believed the child was killed in the apartment and her body moved in a car hired 25 days after she vanished.

Parents 'depressed'

In England, The Sun newspaper has reported the parents are depressed that again wild rumour and speculation is being presented as fact.

The British paper claims it is ridiculous to suggest Madeleine's blood was in the car because she was never in it.

According to Correio Da Manha, the police case against the McCanns consisted of sniffer dogs and that traces of blood indicate the presence of the little girl's body behind a sofa and in the trunk of the car.

Kate and Gerry have always maintained there are innocent explanations for DNA found.

I say that I read the news with a mixture of hope and dread because somehow I still retain a vestige of hope that Madeleine is alive somewhere and will found and she will go home. At the same time, I dread that she is dead and will never be found and laid to rest and also dread that she will be found and what is revealed will be details of a death which shocks to the core of what I want to believe about parents.

Also on the DM forum of January 8, 2008, lullaby reports that the information about the results from FSS has been given out on Portuguese TV news. (RTP) If this is true, then it would seem to be valid confirmation of the news reported by Correio da Manha.

[size=150]Phone intercepts ‘confirm Maddy’s death[/size]

Intercepted telephone calls and emails between the McCanns and their friends have "confirmed the death of Madeleine" say police, according to one Portuguese newspaper today. The intercepts are said to have been made in a joint operation conducted by Portuguese and British police officers.

Diario de Noticias reports investigators have already concluded that the missing four-year-old was killed in the apartment where she slept in Praia da Luz.

It says that Maddy's parents, Kate and Gerry McCann (right), and their friends who were holidaying at the Ocean Club, will be brought in for further questioning. Police are awaiting new tests from the McCanns' Renault Scenic.

According to another paper, Jornal de Noticias, police want to examine inconsistencies in the statements of Kate and Gerry McCann, who were interviewed separately late into the night early on in the investigation. In particular, they want to focus on a three-hour period in which only the McCanns saw Madeleine.

Respected news agency Lusa quotes one police source saying that they think "there's light at the end of the tunnel" and that the authorities have "an idea of what could have happened" to the four-year-old.

Police have known "for a month" that Madeleine had died in the apartment, it is widely reported. The tabloid newspaper 24 Horas says that the police are looking for Madeleine's body in the sea, helped by English sniffer dogs. They have intensified searches around the nearby town of Lagos and along the Algarvian coast, it says.

Blood found in the apartment two days ago has arrived in Britain for DNA analysis: a result can be expected inside 48 hours.

NOW THAT THE PJ HAVE DEBUNKED THE ABDUCTION THEORY AND CAN PROVE THAT MADELEINE IS DEAD, THEIR RE-QUESTIONING CAN NOW FOCUS ON WHEN MADELEINE DIED, WHO WAS RESPONSIBLE AND WHO MOVED AND HID THE BODY:

Now let's also look at this article with (slightly different sequencing to assist meaning) and try to predict what could have happened and who might have been there:

"Portuguese police are desperate to identify the three men seen on the CCTV footage and have had long discussions with British detectives on how to enhance the grainy footage to get clear images of the three faces. They have been told to send all the footage to an FBI lab in America, which has the best equipment in the world for zooming in on CCTV images. The footage was gathered in the early days of the investigation. It was set aside because detectives could not see the faces clearly. But now that the investigation has been reinvigorated by the new chief investigator, Paulo Rebelo, old material is being reviewed. They are in the area for a time and then one disappears and comes back into view. The non-smoker who stays is the one who looks like the drawing of the man seen carrying a child from the apartment. Their behaviour does not look normal. It clearly looks furtive and suspicious but because of the quality of the film it is difficult to make out their facial features.�?BR>

ADD MENTAL ILLNESS TO THE EQUATION:

A Spanish forensic psychologist has been studying the McCanns for quite some time. He states that as a couple they function in perfect unison. Gerry is the dominant partner and gives the orders.

But the "key to the mystery is in the mother". She shows absolutely no emotions. He also says that he has studied Kate's background before May 3 and she has been in treatment for psychological disturbances before. He predicts that she suffers from unipolar or bipolar depression.

Suspect: Portuguese police reportedly came within an inch of jailing Kate McCann
Police came within an inch of jailing Kate McCann over her daughter's disappearance, a new book has sensationally claimed.

Detectives questioning the mother allegedly wanted to charge her with "homicide with eventual intent" - a crime that allows a suspect to be remanded in custody until their trial.

But the night before she was interrogated for the second day, the public prosecutor in the case advised the detective then in charge - Goncalo Amaral - that they did not have enough evidence, it was claimed.

The revelation comes as one of Portugal's top crime reporters states that if the McCanns were Portuguese they would be in jail by now.

Hernani Carvalho suggested that the couple, who are suspects in their daughter's disappearance, only escaped custody as they were given privileged treatment because they are British.

He said: "Many people are up in arms with the privileged treatment that was given to the McCann couple. If they were Portuguese they would have been in jail by now."

His comments follow the publication of a new book called A Culpa dos McCann - the guilt of the McCanns.

It claims that police were torn over whether to accuse her of "negligent homicide" - the equivalent of involuntary manslaughter - which does not allow police to remand a suspect in custody, or the more serious "homicide with eventual intent" - manslaughter.

Portuguese mayor condemns McCanns: 'They are guilty of abandoning Madeleine AT LEAST'
The author, Manuel Catarino, editorial chief of Portuguese daily newspaper, Correio da Manha said Kate was "one step away from prison" on the eve of her interrogation on September 7 when she was officially named as an arguido.

He wrote: "The coordinator of the investigation, Gonçalo Amaral, and the prosecutor Magalhães e Meneses, discussed the possibility of serving Kate up to the criminal instruction judge for him to apply for her to be remanded in custody.

"But both men were consumed by doubts on the telephone: they did not know whether it was a case of 'negligent homicide' which did not allow remanding in custody, or whether to accuse her of 'homicide with eventual intent', a more serious crime, enough to remand the suspect in custody while they await trial. "The prosecutor, with little trust in the solidity of the arguments they had to convince the instruction judge, preferred to wait for better evidence."

Goncalo Amaral, who was later sacked as head of the inquiry, brought Kate McCann in for questioning after sniffer dogs detected specs of blood in their apartment and the scent of a corpse on Kate McCann and in the hire car they rented after Madeleine vanished.

Kate McCann denied any involvement in her daughter's disappearance, claiming that the stains were caused by a nose bleed and she said that any scent of death may have come from her work as a family doctor in Rothley, Leicestershire.

No charges were ever brought against the couple who were allowed to leave Portugal days later. Mr Catarino also claims that police and the McCanns had a heated row about whether to release photographs of Madeleine after she disappeared.

Police were said to fear that distributing the images may put her life in danger as any abductor would panic and kill her, but the McCanns insisted a publicity campaign was their best hope of finding their daughter. "

I am so pleased that 2345 has posted this here as it is a very significant article to add which over the months I have realised that few had had the chance to hear or read about. i read about this information in the CM articles from Portugal but I could never find the links to support what i wanted to comment on:

Pinpointed by cadavers following scent of death found on mother's clothing, bible, car keys and cuddle cat. Cadavers pinpointed corpse specimens in vehicle wheel well with a reported 100% DNA match to Madeleine's hairs & 88% bodily fluid match. More recently, blood found in vehicle matches Madeleine along with reports of towel fibres/blood in wheel well.

No-one has forgotten, especially the McCanns who fled Portugal when presented with the above FSS information at interview. The information broadcast on 7 September on BBC 6 o'clock new was a 'wake up' call to the public - £1.3 m had been taken under false pretences -there was no abduction - Madeleine died in her parents' apartment on or around 3 May.

Parents reject allegations of murder

PORTUGUESE police investigating the disappearance of British toddler Madeleine McCann say they have enough proof to charge her parents, according to a British media report.

The Sunday Mail said detectives planned to travel to the UK to re-interview Gerry and Kate McCann but had enough evidence to mount a case against the couple and expatriate British suspect Robert Murat. The report did not say what crimes the couple or Mr Murat would be charged with.

"Most of the elements of proof have already been collected. We just want to reconfirm the statements made by the McCanns and their friends," a police source was quoted as saying by the paper.

Madeleine disappeared from her family's holiday apartment in Praia da Luz, Portugal, last May while her parents were having dinner at a nearby tapas restaurant with seven friends.

In a separate media report, the Daily Mail said blood found in the McCanns' holiday apartment and rental car had been conclusively linked to Madeleine.

Citing the Portuguese newspaper, Correio da Manha, it said British forensic tests had proved microscopic traces of blood found behind a sofa in the apartment were from the missing child.

The report also said body fluids found in her parents' Renault, rented 25 days after Madeleine disappeared, were also definitely from Madeleine and could not have come from her two-year-twin siblings Sean and Amelie.

The McCanns' spokesman Clarence Mitchell rejected the report.

"It is ridiculous to suggest that Madeleine's blood was in the hire car, because she was never in it. It was hired over 20 days after she went missing which means it was impossible for her to ever have been in it," he said, according to the Daily Mail.

"Kate and Gerry were in no way involved in her death. Nor were they involved in disposing of her body. To suggest otherwise is ridiculous."

Portuguese detectives have in the past alleged Madeleine's parents may have hidden their daughter's body and faked an abduction after the toddler accidently died in their care.

The McCanns were named official suspects last September.

Mr Murat, 34, is claimed to have been seen near the McCanns' holiday flat the night Madeleine vanished.

Mr Murat's girlfriend Michaela Walczuch was this week also named as a suspect. The Portuguese newspaper 24 Horas claimed the German mother-of-one was an 'arguida', or formal suspect, and said Mr Murat's lawyer had named her as the fourth person to be accused by police in the case.

Madeleine 'died the night she vanished' says police chief 239 days ago

Madeleine McCann died on the night she vanished, a Portuguese police chief has said.

Chief Inspector Olegario Sousa said his men had gathered a "record" amount of evidence.

It includes traces of blood found in the McCanns' apartment - currently being DNA-tested at a British laboratory - and the detection of the scent of human remains there by British sniffer dogs.

Mr Sousa also revealed that new official suspects, known as arguidos, may soon be named.

Portuguese newspapers speculated that friends who were on holiday with Kate and Gerry McCann could be made "arguidos", but only over alleged discrepancies in their witness statements and not as suspects in Madeleine's disappearance on May 3.

The friends are back in the UK but could be compelled by EU arrest warrants to return to Portugal. for questioning if they do not agree to go voluntarily.

The dramatic police comments came as Kate McCann revealed for the first time that she and Gerry have discussed returning home without their daughter.

She said: "We know we will be going back and I guess one day we will wake up and it will be right.

"We never thought we would go before Madeleine came back. Now we just don't know but we have our two-year-old twins to consider.

"I can't imagine how we came out as a family of five and could be going back as a four."

Mr Sousa, an official police spokesman, said they were now sure Madeleine died on May 3, just days before her fourth birthday.

He said there was more evidence than the forensic samples, insisting: "The investigation does not depend just on these results." But he gave no further information.
