The Fund

1.1 The full objects of the Fund are:
1.1.1 To secure the safe return to her family of Madeleine McCann who was abducted in Praia da Luz, Portugal on Thursday 3rd May 2007;
1.1.2 To procure that Madeleine’s abduction is thoroughly investigated and that her abductors, as well as those who played or play any part in assisting them, are identified and brought to justice; and
1.1.3 To provide support, including financial assistance, to Madeleine’s family.
1.2 If the above objects are fulfilled then the objects of the Foundation shall be to pursue such purposes in similar cases arising in the United Kingdom, Portugal or elsewhere.
Declaration of Death for Missing Person -the Process

The coroner has to apply to the secretary of state (then home secretary, now justice secretary) under section 15 of the Coroners Act 1988 for permission for an inquest with no body. There is no time limit in such cases; the rule to wait seven years may only apply in the High Court on the settlement of an estate.
The Role of the Police

An inquest without a body operates very much on the evidence provided by the police and whether senior officers believe the individual in question has genuinely died (the Pj)
However, when someone goes missing, the police will try to establish whether the person has died by checking bank accounts and investigating possible sightings.

the sightings keep the fund (& Madeleine) alive and a chance to funnel the money elsewhere before it has to be handed over

Interesting you were mentioning this, and it ties in with what was said on here the other day about arrests in the UK being many in relation to this crime. I was of the opinion that it was the concealment of the crime that more people were involved in, however, it does only take a couple of people to use, oh lets say a private fund for perhaps not strictly legal purposes ?
If this was the case then certainly detective work would be covertly undertaken as to not arouse any suspicion from the fund directors until they had identified who was doing what and for whom.
