G.I.L.D. Online Licensing Program Terms of Use
 
GROUP MANAGERS, OWNERS & ASSISTANT MANAGERS �?PLEASE CHECK YOUR GALLERIES AND MAKE SURE THAT ALL INTERNATIONAL ILLUSTRATOR, LLC & G.I.L.D. ARTIST'S IMAGES ARE IDENTIFIED CORRECTLY WITH COPYRIGHTS, LICENSE NUMBERS AND WATERMARKS. THIS IS REQUIRED BY LAW.
 
1. No G.I.L.D. Artist image may exceed 72 ppi
 
 
No G.I.L.D. Artist image may exceed 5" on its longest side
 
 
No G.I.L.D. Artist image, composition or product may be sold or bartered or used for profit or "break-even" endeavors in any way. Donation buttons are not permitted on sites using G.I.L.D. Artists' images.
 
 
All G.I.L.D. Artist images must have the artist's full name and copyright symbol plus your G.I.L.D. License# and watermark clearly legible (this may be placed within 1 cm from the G.I.L.D. image in a border or blank canvas around your tag). You may not place a copyright mark with your name on or around the image as it is considered a derivative work. You can, however put "tubed, tagged, sig by" or your watermark.
 
 
G.I.L.D. Artist Images may not be modified, changed, animated or cut apart (except tubing for personal, individual use only). You may use partials of the images as long as the full intact image is represented on the tag. Borders, lettering, names, etc. may be added, animated, twinkled, etc. to enhance the main image.
 
 
You may not blend any G.I.L.D. Artist's work with the work of another artist. You may only add embellishments you have permission to use, or that you make yourself.
 
 
All illegal use of Artist's/International Illustrator, LLC images must be reported to [email protected]
 
 
II, LLC reserves the right to use all creations (tags, poems, etc.) for marketing and other advertising and promotional purposes in cooperation with the original Artist. All tag makers must provide contact and copyright information in order to receive credit for their tag creation(s) in any publication.
 
 
G.I.L.D. Friendly Groups are asked (but not required) to create a section/area (not a whole page) identifying G.I.L.D. Artists and linking to their sites (if permitted), featuring the International Illustrator/G.I.L.D./PSPGroups logo.
 
 
You may use only the G.I.L.D. images in your Licensing Package. If you have been using G.I.L.D. Artist images for which you currently do not have a G.I.L.D. License, those may not be used.
 
 
G.I.L.D. Artist images may not be used in any commercial endeavor. To find out about commercially licensing artworks, please contact [email protected].

International Illustrator will make every effort to broadcast any changes that may occur, but you we suggest you bookmark and check this site regularly for updates. If you are aware of any high resolution images on the internet or violators of any artist’s copyright or II, LLC’s copyrights or TOU, please notify us immediately. All information is kept confidential, but we will take legal action against any copyright violators.
 
Q&A Below
What is G.I.L.D. and why is it necessary? Groups International Licensing Delegation is the non-commercial licensing arm of International Illustrator, llc. G.I.L.D. manages the non-commercial licensing of the intellectual property under our licensing jurisdiction. G.I.L.D. works with Artists, Individuals, Groups & Groups Participants, to facilitate and foster the legal use of artistic content, adding value to both the copyrighted artworks and the forums in which they are enjoyed. The phenomenal growth and popularity of online forums & Groups over the past 5 years has resulted in rampant copyright abuse and the pilfering or "snagging" of copyrighted intellectual properties on the internet. G.I.L.D. works with Groups Mgmt and Members to ensure copyright laws are respected.
 
What is a G.I.L.D. License and how do I purchase one? A limited use license gives you legal permission to use specified copyrighted intellectual property (in this case, artwork images) within certain stated parameters. A license for International Illustrator's Artist's images can be purchased affordably on our website. Who needs a G.I.L.D. License? Anyone who wishes to use the copyrighted intellectual property of another person or entity must first obtain a license, or permission, to use the property for any reason whatsoever. It belongs to it's Creator (in this case - Artists), who has complete reign over his or her artworks. You need a license if you intend to use the image(s) in any way (including displaying the image on your website or tagging with them).
 
 
Why should I get a limited use license if I can just snag images from the net without costing me a dime? Without a license you are in violation of copyright law, a federal offense. This brings with it a hefty fine and possible jail time. The FBI frowns on copyright violation as do online hosts (i.e. Microsoft, Yahoo!, AOL, Google, eBay, etc.). Purchasing a license will protect you and your groups from prosecution and fines.
 
 
How do copyright violators affect the licensing costs for the rest of us who purchase a limited use license? Copyright violators break the law (a la Napster before fines started being handed out). International Illustrator's (G.I.L.D.) Artists are united to defend their rights, resulting in prosecution of violators who refuse to uphold the law and adhere to copyright laws and G.I.L.D. Policies. Costs to pursue and prosecute infringers will affect the cost of Licenses.
 
How much will a limited use license cost? The cost for your license will vary depending on your plan of choice. Whether you purchase a personal license for just your own non-commercial website, a license to use the images in your group or groups, or a package which includes "tubes" of images, we have a very affordable plan for you here!
 
Do I have to purchase products from the G.I.L.D. Artists and purchase a limited use license? G.I.L.D. is an opportunity for all license holders to begin collecting the artworks of their favorite artists. International Illustrator's new site: www.pspgroups.com is specifically for PSP, Art, Graphics and Groups enthusiasts. We have wonderful complimentary items on the site as well as some items you may wish to purchase.
 
Which Artists are covered under each limited use license? Each artist is a separate legal entity; available images for each will be determined by the G.I.L.D. Artist. Individual licenses may be purchased for any single G.I.L.D. Artist or series of Artists, or you may choose to purchase a "multiple" or "all inclusive" license package for one or more artist. For how long is the limited use license valid once I purchase it? Each license is a contract for a lifetime of non-commercial use for images released for the particular Image Package(s) you License. Each year, G.I.L.D. Artists will release new images for licensing and with renewal of your limited license with G.I.L.D., we'll give you opportunities to collect your favorite artists, enter contests for original artworks, chat with the Artists and more!
 
What are the Terms of Use, or Rules of Use for the images once I obtain my license? The Terms of Use (TOU) for using the images with your limited license are most likely very similar to those you are already following. It is important, however, to understand that the TOU may change periodically, depending on the law and the wishes of G.I.L.D. artists. You are encouraged to read the Official and complete G.I.L.D. Terms of Use here!
 
What are my payment options? We accept all major credit cards and debit cards, electronic checks and checks by mail. Online, you can subscribe using PayPal. If you do not have a PayPal Account and would like one, please let us know [email protected].
 
Does G.I.L.D. supersede permissions I have already received from G.I.L.D. Artists? G.I.L.D. Artists are united to protect their copyrights and the value of their artistic creations. The G.I.L.D. Online Licensing Program supersedes all previous agreements for the limited, non-commercial use of their artworks and nullifies all previous Terms of Use, verbal agreements and understandings you may have with any G.I.L.D. or International Illustrator Artist.
 
Under what circumstances can more than one person share the same limited license? Under no circumstances may a limited use license be shared.
 
Will I be able to use my limited use license for all my groups? Your limited use license may be used in any Group in which you participate. However, it must be stressed that if any Individual or Group knowingly & willfully violates or supports violations of copyrights, that Individual or Group is subject to investigation and if the violation is not remedied upon Notice, will be subject to prosecution to the fullest extent of the law.
 
Will our limited use license cover the msn group or just the individual? The G.I.L.D. limited use licenses are for individuals only. There are no G.I.L.D. Licenses which cover entire Groups at this time.
 
What happens to the tags we already made with G.I.L.D Artists work on it? Regardless if you have received previous permissions from a G.I.L.D. Artist or Artists, all previous arrangements are null and void with the implementation of the G.I.L.D. Online Licensing Program. You must either purchase a license to continue sharing, working with and displaying copyrighted artworks or delete all protected images from your Groups, Sites, Forums & databases.
 
 
How do I go about continuing to use artworks for which I have permission under the previous system? G.I.L.D. Artists will no longer be offering their full portfolios for use under the G.I.L.D. Program. Periodically, a new selection of images will be released from each artist with the opportunity to license them for the following year. You may use only images for which you have a G.I.L.D. License.
 
Do non-profit/non commercial taggers need to buy a limited use license? The G.I.L.D. program exists solely for the non-profit/non-commercials users of these copyrighted images. Anyone wishing to use the images in a commercial manner must contact International Illustrator directly for a commercial license contract.
 
How will we know who has G.I.L.D. License and who hasn't - how will it be policed and how do we make sure our Groups and its Members are in compliance with the licensing law? Under G.I.L.D. guidelines, each tag created with a G.I.L.D. Artist image must have the G.I.L.D. License # of the individual who has a license to use it, the individual's watermark and the Artists' copyrights. Improperly identified images or images with missing, or no information, are not legal and the proper action should be taken to make sure the individual or Group using them obtains a G.I.L.D. License from International Illustrator or discontinues their use immediately.
 
How do we save all our Groups hard work and comply with the new rules by the time they are implemented? We appreciate the fact that you have worked hard to create so many wonderful creations in your Groups over the years. By purchasing a license for the available 2005 images for 2005, you will be allowed to save any work you have created by identifying it with you new limited license #.
 
I am an Artist. How do I join the G.I.L.D? If you are an Artist interested in protecting your artwork by offering licensing through International Illustrator, llc, please contact us via email. With your email, please attach a sampling of your work, any sites where it can be viewed and other pertinent information. A representative of International Illustrator will contact you within 24 hours.
 
Is there a referral program? International Illustrator does currently has a referral program which allows you to minimize the cost of your G.I.L.D. License and earn FREE G.I.L.D. LICENSE.

GILD will no longer be handling any artists tubes or images as of January 1, 2007.
Current license holders will still be able to download their tubes once the site has been revamped.
 
Current info is that they have been acquisitioned, in which there is no further details available at this time.
  It looks as if they are moving away from the PSP world.
