OK, when our home sold the Realtor chose a Lawyer, a friend of hers for us . I was out of state when this happened and couldn't remember the name of the Lawyer I had before so we took hers. Most of you know the contract was cancelled and I have refused to sign the cancellation form as of yet. The realtor finally got the proper form signed by the buyer but I won't sign yet. I fired the existing Lawyer 2 weeks ago. I asked two weeks ago for my files with the Lawyer to be sent to my new Lawyer. I have been given the run around on it all and promised three times that they were mailed out. Now we find out the buyer is upset and had the nerve to call my Lawyer, he was given the number by the old lawyer! Agh!! I let my realtor know how mad I am over this all. My new lawyer called and said she was told the file would be mailed today. She told me things sound fishy with all the delays, etc and she will be combing the files with a fine tooth comb! If anything is out of line or not done in the proper time frame the buyer will not get his money back. I should not have to be dealing with this. The realtor will be fired after all files are in my new lawyers hands. Agh....Just me venting today!!!!!!!!!! |

I would be talking to the real estate commissioner and the bar association. In the state I had my realtor's license in, if the buyer baced out, they'd lose whatever funds they had put in, and they could be forced to buy anyway under what is called "specific performance" in the law. I'd ask my attorney if that applies there too. You have every reason to be mad and I'm glad you are refusing to sign anything at this time. You go, girl!! |

I agree with Yenna. Lawyers have never been high on my list and this put another strike against them. Now you have to go through the process of showing the house all over again and more time away from dh. You should be compensated for your time and suffering. |

Thanks eveyone! I have definitely learned alot through this ordeal. The next contract I have will have lots of stipulations including we gain the earnst money no matter what the reason if the house doesn't close. |

WHOA...HOLD THE PHONE!! Are you saying they want their "earnest money" back? Hey! That isn't returnable. That is what removed the house from the market. They can't have that back. I thought they might be fighting you over the entire down payment. What are these freaks? |
