Creative Image Licensing & Management (CILM) Standard Terms of Use (TOU)
PLEASE READ THESE TERMS OF USE CAREFULLY. PLEASE MAKE SURE THAT ALL OF CILM ARTIST/PHOTOGRAPHER IMAGES ARE IDENTIFIED CORRECTLY WITH COPYRIGHTS AND LICENSE NUMBERS.  THIS IS REQUIRED BY LAW.   
 
1. No CILM Artist/Photographer Image may exceed 72 dpi (dots per inch) or ppi (pixels per inch).
 
2. No CILM Artist/Photographer image may exceed 7 inches (17.78 cm - 504 dpi) on its longest side.  
 
3. No CILM Artist/Photographer image, composition or product may be sold or bartered or used for profit or "break-even" endeavors in any way. Donation buttons cannot be placed on sites using CILM Artist/Photographer images.  
 
4. All CILM Artist/Photographer images must have a copyright symbol (©), Artist/Photographer's full name, website (if applicable according to the rating of your group), plus your CILM License # clearly legible (this may be placed within 1 cm from the CILM Artist/Photographer image in a border or blank canvas around your tag). When placing your credit on the tag you can place "tubed, tagged, sig by" or your watermark but you CANNOT place a © symbol next to your name.
For G or PG rated groups use:
© Artist/Photographer name - CILM license #
or
© Artist/Photographer name, www.artist/photographerwebsite.com, CILM license #
For R or adult rated groups:
© Artist/Photographer name, www.artist/photographerwebsite.com, CILM license #
 
5. The integrity of CILM Artist/Photographer Images may not be modified, or changed (except tubing for personal, individual use only). You may use close-ups (if available through CILM) of various images on your tag just be sure that all of the artwork contained in your tag are of one CILM Artist/Photographer only and no others (see TOU #8). Elements of the tags such as hair, and clothing may be sparkled but not animated in any other way. Borders, lettering, names, etc. may be added, animated, sparkled, etc. to enhance the main image. You may make eyes of any CILM Artist/Photographer image blink but you may not make limbs, breasts, or hair move. Absolutely NO "BREATHING" images.  
 
6. Changing any CILM Artist/Photographer image to black and white or monotone is permitted only when making a monotone or one-color signature tag. If you do this you must not have more than one color on your tag other than the name or message you put on the tag or the copyright information.
 
7. Placement of "small" elements to cover prohibited parts of CILM Artist/Photographer R rated images in order to allow for their usage in PG rated groups is permitted.
 
8. CILM Artists' work may not be blended with the work of another CILM Artist or any other Artist not affiliated with CILM. Do not mix Artists.
 
9. CILM Photographers' may not be blended with the work of another CILM Photographer or any other Photographer not affiliated with CILM. Do not mix Photographers.
 
10. Stock photography may not be used in any signature tags created with any CILM Artist/Photographer. You can, however, combine any CILM Photographer with any CILM Artist.
When combining CILM Artists and Photographers you must display copyright information like this:
Artwork © Artist name, website (if applicable according to the rating of the group)
Photo © Photographer's Name, website (if applicable according to the rating of the group) - CILM license #
*Both lines must be on your tag.
Usage of your own photography in the background of tags created with CILM Artist images is permitted however use of your own photography with any CILM Photographer image(s) is NOT permitted.
 
11. All illegal use of CILM Artist/Photographer images should be reported to [email protected]
 
12. You may use only the CILM Artist/Photographer images in your Licensed Packages.  If you have been using CILM Artist/Photographer images for which you currently do not have a CILM Artist/Photographer License, those may not be used unless you have a CILM Artist/Photographer License.
 
13. You may create tutorials using CILM Artist/Photographer images however you must very clearly state on the page that persons following the tutorial must not use the same images in the tutorial unless they have the appropriate CILM Artist/Photographer license to do so.
 
14. CILM Artist/Photographer images may not be used in any commercial endeavor.  To find out about commercially licensing photos, please contact the Artist/Photographer individually through their website links on their individual pages on this website.
 
15. Snag tags are permitted. Blank tags are NOT permitted.
 
16. CILM Artist/Photographer images may not be printed in any way, shape or form.
They are for online use ONLY!
 
17. Sharing of images or tubes in packages (or complete packages) is absolutely NOT permitted. Failure to comply with this could result in the forfeit of your license # and the usage of purchased images.
 
Now that you're finished reading the Standard Terms of Use please be sure to refer to Artist/Photographer Amendments to the Standard Terms of Use (if any) on their individual package pages.

The following is Creative Image Licensing & Management (CILM) Standard Terms of Use (TOU). These terms apply to all graphic hobbiests being signature tag makers, stationary and web set makers, website designers and MySpace or other social network users. You are required to read, understand and abide by these terms when using the digital artwork of any artists represented by CILM. You are advised that these terms are strictly enforced at all times by CILM, our Artists and our Attorneys. CILM is represented by the law firm of RMKB in Los Angeles, California.

The Artists and Photographers represented by CILM reserve the right to amend any of these terms they so choose. Artists amendments can be found under "Artists Quick Reference" on their respective package pages and in our CILM Forum, www.cilmforum.com, under the Artists TOU heading. Standard Terms of Use and any Artists amendments are provided with your package orders as well.





 

Creative Image Licensing & Management
Standard Terms of Use

* Any future changes will be indicated in Coral color. *




 
1. No CILM Artist/Photographer image may exceed 72 dpi (dots per inch) or ppi (pixels per inch) (for the metric it can be no more the 29 pixels per cm).




 
2. No CILM Artist/Photographer image may exceed 7 inches (17.78 cm �?504 ppi(199 pixels per cm)) on its longest side.




 
3. No CILM Artist/Photographer image, composition or product may be sold, bartered or used for profit or “break even�?endeavors in any way OR used in association with any site "requiring" membership fees to join.




 
4. CILM WILL ALLOW your group or website to have a Donation Button AS LONG AS THE FOLLOW CONDITIONS ARE MET: (a) A Donation may NOT be a "requirement" to join your group or access your site.
(b) No other digital image licensing company affiliate programs may be used in a group or on a site that has a donation button and is using CILM artwork.
(c) A CILM staff member must be allowed to join the group or access the website at all times.
(d) The Terms of Use must be clearly posted for your group members and strictly adhered to at all times. Failure to comply with any of the Standard TOU’s, Artists Amendments or conditions set forth above will result in a request to remove the donation button from your group or site.

*Note: Group owners and administrators do not have the sole responsibility of making sure that all group members are following the CILM TOU's. This is why item (c) is listed above. The presence of a CILM staff member is required so that owners and administrators have assistance with helping members properly follow CILM TOU's.




 
5. All CILM Artist/ Photographer images and tube creations MUST be credited in the following manner:

©Artists / Photographer name, www.artists url.com, ( your CILM license number )

(a) Your CILM license number MUST be clearly legible on all of your digital creations. This includes, but is not limited to tags, stationary, web sets, MySpace pages or other social network pages, personal websites, other website layouts or skins, banners and any other digital means of design.
(b) You MAY put tubed by____ or tagged by_____ and your watermark on your creation however you MAY NOT put a copyright symbol next to your name.
(c) You MAY NOT place your personal, group or website URL on your creation.
(d) You MUST place the Artist / Photographer URL on your creation.

Note: Some of our Artists have R or PG-13 rated material on their websites. URL’s to websites containing “Adult Content�?are not allowed in some groups. CILM understands this therefore we do not require that you place an Artists�?URL on a tag when your respective group does not allow it. Here is the alternative way to display your tags in the event a URL is not allowed:

©Artists / Photographer Name, (your CILM license number)

This alternative method is ONLY to be used in groups that do not allow "Adult Content" links to be displayed, ie. MSN groups. The Artists URL should appear on all of your creations in ALL other instances especially in social network website pages.

The above outlined copyright display terms apply to ANY and ALL creations using CILM Artist / Photographers works. This includes, but is not limited to tags, stationary, web sets, MySpace pages or other social network pages, personal websites, other website layouts or skins, banners and any other digital means of design.




 
6. Group Banners MAY contain your group URL as long as all other copyright credits are present as outlined in term #5.




 
7. You MAY NOT alter the artwork or photography in anyway. You must use the image AS IT IS PROVIDED TO YOU BY CILM.




 
8. You MAY tube images yourself.




 
9. You MAY NOT receive monetary compensation for tubes or images, tags, stationary or web sets of any artist with CILM.




 
10. You MAY NOT share tubes or images in anyway be it via email, disk, file sharing site or any other known methods of file sharing.




 
11. You MAY NOT have another individual tube images for you.




 
12. You MAY use “close-ups�?IF they are available through CILM.




 
13. You MAY NOT animate limbs, hair, breasts, buttock, lips or clothing. (Check individual amendments for exceptions to this term.)




 
14. Animation that simulates breathing is STRICTLY PROHIBITED.
*Note: Some Artists do allow full animation so please check Artists Amendments for exceptions to the animation terms.




 
15. You MAY use sparkle effects for hair, clothing, lettering, etc. and you may animate eyes for blinking.




 
16. You MAY NOT change any Artist / Photographer image to black and white monotone UNLESS you are making a monotone (one color) creation.




 
17. You MAY NOT change any Artist / Photographer image to black and white and then colorize it again yourself.




 
18. You MAY take an EXISTING black and white Artist/ Photographer image and colorize it yourself.




 
19. You MAY place small elements on images in order to “cover up�?prohibited body parts. This is to allow for usage of rated R or PG-13 images in more modest groups.




 
20. You MAY NOT clothe CILM Rated R images. You may only use clothed Rated R images that are offered in PG rated packages through CILM.




 
21. You MAY NOT add your own embellishments such as hats, socks, shoes, stockings etc.that have not been provided as part of the original piece of artwork to you by CILM.
*Note: Exceptions are sometimes made for holiday occasions. Visit the CILM Forum for updates on this term.




 
22. You MAY NOT “mix�?Artists from CILM or any other licensing company in your creations however you MAY mix pieces from the same Artist.




 
23. You MAY NOT “mix�?Photographers from CILM with other CILM photographers, with your personal photography, with stock photography or with any other photographers from other licensing companies.




 
24. You MAY NOT use stock photography with CILM Artists in your creations.




 
25. You MAY use your own personal photography with CILM Artists creations.
*Note: If you choose to use your own personal photography then you must display your creations in the following manner: Artwork © Artists Name, www.artists url.com, Your CILM license number Photo ©Your "Real" Name, CILM license number




 
26. You MAY combine CILM Artists with CILM Photographers. Here is how you MUST display your creation: Artwork ©Artists Name, www.artists url.com, Your CILM license number Photo ©Photographer Name, www.photographer url.com




 
27.You MAY create tutorials using CILM Artist / Photographer images however you MUST very clearly state on the tutorial page that the image you are using is for example only. Anyone wishing to use the same image in their own personal creation MUST have the proper license for that image.




 
28. CILM Artist / Photographer images MAY NOT be used in ANY COMMERCIAL ENDEAVOR.




 
29. You MAY NOT create BLANK tags, stationery or web sets etc. There MUST be "prominent" text on your creation besides the required copyright information. Faded type in the background of your tag is not enough to constitute a sufficient tag - You MUST have type such as your name, "Hello", "Happy Birthday", etc. prominent on your tag.




 
30. Any stationery (stats) created featuring CILM Artists or Photographers MUST contain copyright credits in two places.
1. By the actual artwork on the stat.
2. In the credits at the bottom of the stat.




 
31. You MAY NOT print any images, tubes or creations made from CILM Artists/ Photographers works. The digital art and photography provided by CILM is FOR ONLINE USE ONLY.

CILM has been hit with a big problem concerning MSN groups. This is quite a mess folks...

We have heard that MSN has now adopted a Family Friendly policy (which we completely respect) in which they do not allow Adult Content url's in their groups. They are also not allowing links to G-rated sites that may in turn have Adult Content links on their web sites. This, of course, violates CILM's TOU for image use and hurts one of our main priorities at CILM.

CILM wrote specifically to MSN and asked them for an official word on this. We received the following response:

Thank you for writing to MSN Groups.
We sincerely apologize for the delay in our response and for the inconvenience this has caused.

With regard to your inquiry, please note that mentioning your company name in MSN Groups is not considered as a violation of MSN Groups Code of Conduct. Same with indicating the name of the artist that produces adult content material is not considered as violation.

As with containing links to sites that contain materials that are prohibited by the MSN Groups Code of Conduct as described in your third question, A G-rated site would still be considered as a site that violates the MSN Groups Code of Conduct if it contains this link. Thus, the posting of the materials that your described is not permitted in MSN Groups.

MSN clearly states that the mention of an artists name or our company name is NOT a violation of their Code of Conduct. They also clearly state that A G-rated artists url may not be used in MSN IF that artist has links on his or her site that lead to any Adult Content sites.

When CILM began it was Anthony's main focus to give the artists as much credit as possible for their artwork and to have their artwork link back to them, not CILM. We are accepting of MSN's policy not to have "live" links back to Adult Content web sites in their groups however we are not in agreement at all with the fact that they will not allow you to link to a G-rated artists that may have an AC link on their web site. We feel that MSN is overstepping their boundaries with this policy and is attempting to dictate to the general public who they can and can not link to on their own personal web sites. This is especially hurtful to the art industry. Be that as it may...

Since we do not expect MSN to change their rules and because we are committed to finding a solution that accommodates our artists, customers and the MSN Code of Conduct, we are making an exception to our TOU's for image usage in MSN groups ONLY.

All creations made with CILM Artists and used in MSN Groups can be displayed in the following manner:

©Artists name, Your license number

Basically the url link for all CILM artists is being eliminated for use in MSN Groups ONLY!!!!!! * In all other groups you MUST place the artists URL on your tags.

Please note that if you do not belong to any MSN Groups at all then the information above does not apply to you. You must continue to display your tags with the artists url on them as normal.

This change is of a big concern to our artists and we are in the process of notifying the artists of this situation so they can offer their solutions to the dilemma. We do have one artist - Jo Lynch - that has changed her web site. to be compliant with MSN's Code of Conduct. She is still requiring her url on ALL of your creations made with her work. She has removed any live links from her web site. that link to Adult Content web sites. so her url is safe to use in ALL MSN groups.

Hi Everyone,

Hope everyone is having a great start to the year.

This newsletter is just a reminder of some of the closeouts that are currently on the CILM site. There is an artist that only has one more day with CILM: Gary Ham. If you don't have any of Gary's packs or you need another one or two to complete your Gary Ham collection you have until tomorrow at 6pm to pick up those Garys.

Please note that when an artist leaves CILM it is almost always under spectacular terms and with an open door in the future to come back. Gary is an incredible artist and person and hopefully when some of his job obligations come to term he can sit back and create some more great, incredible images for you all to tag. We absolutely wish Gary the very best! (Have you seen his "Haminals"?)
