Union goes to court to get Wal-Mart to re-open in Saguenay

The union representing Wal-Mart employees in Saguenay, Quebec, has gone to court to try to get the store re-opened -- with union employees.

The Food and Commercial Workers Union has asked Quebec Superior Court to overturn two Quebec Labour Relations Board decisions that supported Wal-Mart's decision to close the store after the employees were unionized.

In its request for an appeal, the union wants the court to order the labour board to reconsider its rulings.

The store, 250 kilometres north of Quebec City, was Wal Mart's first North American location to unionize since a Windsor, Ont., outlet was briefly accredited several years ago. The Saguenay store was to close May 6, but shut its doors a week earlier.

On May 11, the Quebec Labour Board rejected a request for a provisional injunction to order the store reopened. On July 7, three Labour Board commissioners rejected a union appeal of that decision.

The union argued the closure of the Saguenay store was designed to intimidate other workers who might want to unionize.

Wal-Mart said the store closed because it wasn't profitable. Its lawyers argued that Canadian law recognizes an employer's right to close a location regardless of its motives.

The union's filing to the Superior Court said the labour board abandoned its responsibilities by failing to rule on the legality of closing the store.

It said the closure of a location in a chain of stores can't be viewed the same way as a single store. "It's not about an employer deciding to stop his operations, but rather about sacrificing a unionized location in order to prevent the unionization of other locations."

So... the store was scheduled to close ANYWAY on May 6?  I don't think I've ever heard of Wal-Mart closing a store.

Walmart only released the store would close though after the workers were certified not before other than a threat that they made. I sent a e-mail to a regional over that area as a customer, who told me they had no intention of reopening any stores in that area in the future. I found out that in Canada if a store would reopen they would have to accept the union, so that probably is why walmart doesn't really want to reopen it.
 
Did you not hear about the store that closed? I can post articles if you want. Also walamrt has closed stores that aren't profitibale in other areas also, including the U.S. though.

Wow... seriously, I had never heard about a store closing due to profit.  I had heard about the one in Canada closing... but not any in the US.  I'd like info on those in the US if you have it.

I didn't know the store in Saguenay, Quebec closed. The only store I knew of for sure that closed in Quebec was the store in Jonquiere. If you guys want, I can post an article about that store closing, or give you some back ground info on it and why they closed.

No Wal-Mart smile in Jonquière

JONQUIÈRE, QC – Hundreds of Jonquière area citizens gathered to show the true face of Wal-Mart by forming a giant mosaic that transformed Wal-Mart’s logo from a smile to a sneer.

The rally was just one of many gatherings and protest rallies held on May 6th at Wal-Mart locations across Québec, one week after 200 Wal-Mart employees in Jonquière were let go and their store shut just months after they became the only unionized Wal-Mart location in North America.

May 6th was the day Wal-Mart said they would shut the store. They actually shut it one week earlier on April 29th, without notice, to escape the attention of local citizens and the media.

A recent Polara survey showed that more than 80% of Canadians dismiss Wal-Mart’s claim the store was losing money. Most Canadians surveyed said Wal-Mart shut the store to frighten other Wal-Mart employees from unionizing.

In spite of Wal-Mart’s move, two other Québec Wal-Mart locations have since been certified in Saint-Hyacinthe and in Gatineau. Applications to certify 12 other Wal-Mart locations across Canada are also pending.

Wal-Mart slams the door on unionized store earlier than announced

Workers dismissed after deciding to join a union

JONQUIÈRE, QC - Wal-Mart Canada today shut a recently unionized store in Jonquière, Québec, a week earlier than the previously announced. In February Wal-Mart said it would shut the location on May 6, 2005, just months after the store was unionized by UFCW Canada (United Food and Commercial Workers Canada).

The decision to close early comes days after the Québec Labour Commission ruled it would consider an application by UFCW Canada to force Wal-Mart to keep the store open until a series of unfair labour practice charges filed against Wal-Mart were ruled on by the commission.

The earlier than announced closure was not wholly unexpected. Wal-Mart had progressively emptied the store over the last month and accelerated that after Wal-Mart became aware of a National Day of Action by labour activists planned for May 6th at various Wal-Mart locations in Québec, and May 7th at Wal-Marts across the rest of Canada.

“Wal-Mart’s decision to sneak out of town early was no surprise,” according to Michael Fraser, the national director of UFCW Canada. “Every bully is a coward and Wal-Mart was afraid if they waited till next week the media and outraged local citizens would be there for the closing.”

“They were also scared that the labour commission might order them to keep Jonquière open. Once again Wal-Mart has demonstrated that the only rulebook it plays by is its own.”

In spite of the early closure, the National Day of Action events will proceed next week, as will first contract arbitration between TUAC 503 and Wal-Mart regarding the Jonquière store.

Arbitration is scheduled to commence May 11th under the authority of an arbitrator appointed by the Quebec Ministry of Labour. First contract negotiations also continue for a Wal-Mart store recently certified in Saint-Hyacinthe, Québec.

Vickie---Yes, not sure on the exact city/state locations off the top of my head. When i was in the mtp, we talked about how it is has happened. Also, i came across a website that listed areas that walmart left citing many reasons, which included profit. Sounded like a lot of areas they entered they weren't greeted warmly and it continued in that way. Will post when i come across the info. t hough.

Hey, didnt' take long to get a brief answer. I sent a e-mail to a website manager buddy of mine, who responded back immediately. I will post the information he knew right off the bat. He didn't know without looking around for the information on his site.
 

Nowata and another store in a nearby city, closed saying each was not profitable alone. Later opened a supercenter in Bartlesville

Jacksonville Texas----changed about meat section

Wal-Mart bought out Woolco (around 120)—closed them down.

Several stores in Iowa have threatened to close along w/numerous other cities if the cities did not give them bigger tax breaks among other items, which they  did receive.

Known to close 2 walmart stores to open 1 supercenter.

Will post more information if i come across it or if he sends me more information.

Not sure where Nowata and Bartlesville really are, but i might add he did note a big time frame difference between the time they closed the 2 stores and decided to that another store would be profitable as 1 big store.

Vickie---I think i read that you said you were an assistant?? Just curious if you went to Food School, and if so if your instructor let you see a footage tape he showed the CEO of walmart at the time on news clip that attacked a walmart store for poor sanitation, and how the CEO and others around him in this big meeting were eyeing one another while it was playing, and were trying to find out where it happened. Regional managers were looking at the district managers who nervously were saying no didn't happen in my stores, and were hoping it hadn't. Turned out that it was a made up video footage designed to get a reaction just like he got, and bring about awareness of the seriousness of proper sanitation. Very informative and very tactful. I thought it was real, when i first seen it.
