I haven't been active lately, between playing medication roulette and dealing with the fun filled game of workmans comp, I've had my hands full. I have been reading the posts though. Hope everyone is having a pain tolerable day. |

Hi Nukez, It is so nice to meet you. I am glad you check the boards often. We are making a few changes here and there slowly and I hope it it a good thing. We always welcome your feedback on what you find here. My husband is also fighting workmans comp and it is such a hassle. It just ruins his day. It just wears you out sometimes with all the doc's and lawyers and workmans comp. Just never ending. I hope you have a good lawyer. They should be dealing with workmans comp for you and you'll probably get more cooperation. If you have any questions or suggestions please don't hesitate to post them or you can email me directly. One thing I can tell everyone here about workmans comp Doctors & Lawyers is that most of them work with the same couple of comp insurance companys all of their life and they have a great repore with each other...in other words most comp lawyers are in bed with the insurance companys and they get the same kick backs as the comp Doctors when they ingnore the patients needs to save the insurance companys money....dont trust either of them! I had to fire one comp Lawyer when I proved he was in colusion with the insurance company, he walked away with nothing after 2 years of what he called work. When I hired the second comp lawyer I told him he better not even look like he is working for the insurance company, turned out he wasnt and I got 4 times the settlement the first lawyer told me was the maximum for me and actually threw a book at me when I declined their offer. I ended up with more money for a medicare set aside than the first offer....Make sure that you are on SSD first and that SSD is a part of the settlement because they wont pay for RSD needs if their is a comp claim...thats where the medicare set aside comes in, its money that you pay for your RSD medical needs, if medicare is involved and agrees on the amount and you spend it all and need more then medicare will start paying |

Hi Frank, and all who are here because of the monster condition RSD! I am so near the end of my wits. I do so much research on anything I can get to give my WC lawyer who refuses to say "RSD" in his representation of me. They (WC) want to make a settlement only for my disability related to my broken hand. Which didn't heal all that well because my rsd. Ok, that is where I am right now... but I do need to know if any of you have ever heard of a company called... "Pre-Paid legal service Inc."?? It's a legal insurance, you pay $26.00 a month, for legal advice, and from what I found in the "fine" print. There is a charge for using a lawyer after a certain amount of pages and time. They advertise to have lawyers in every state... Anyway! If anyone can give me something to use... get my lawyer informed. [email protected] Thanks and God bless us all! ladonna

Good morning, Saw your messge and here is my experience with the legal service you wanted info. Great $26.00 if you want to ask a lawyer about a process, or to write a letter on your behalf. It is strickly minor stuff. Not much help really. It is good income for a few selling it. Oh, can't really remember. biut when I tried it a few years ao, I think they might have done wills. Could be wrong. Now, I am currently in a new battle with w/c after 13 years on perm dis. In addition, I draw ssdi. My attorney advised me that if our new judge does not overturn the disability ruling, there may may be the option of settling which would mean no more threats and expensive attorney fees at 20% out of checks and any settlement fees for the rest of my life. No cash, then 20% was my only option. No win, attorney gets zero. I
would suggest that you go on line to your division of w/c or call the w/c division in your state. In Colorado, I found info that gave some info on settlement calcs and other stuff. In Co, w/c rarely offers more that in the $80K range. However, if ssdi is not an issue, the settlement could be much larger with life time checks still coming, Since auto insurance has tables for liability payout settlements. that are are frequently adjusted up based on the injury and other things. Speaking with w/c division may give some personal info that might support attorney's advice or offer you some info to ask questions about. Hope you checked on attorney recommendations from other friends, because the internet and other resources could possibly have you working for a "pennies on the dollar kind of settlement" that some ambulance chasers like to get. It can be fast
turnover, and some people just want to forget and move on. Best of luck. Hope you get tons of advice form people with experience.

I guess that last message was meant for me... Anyway, I have been getting information about RSD, anything I can find to send to and hopefully help make my lawyer aware of the problems, and also there are some stories that are about people that get the right treatment, and early enough that do help them. WC denied me early treatment, even though I was diagnosed in less than a month after my accident. I'm in so much pain, and sitting here alone... I guess I don't make much sense. Like I said, I'm just about at my wits end. I'm just venting...

Hey there Lad,,,,,, good too read your typing... It is really good too vent.. Posting here helps us also too know n understand what you are going thru. Not a problem one... Not one at all. Maybe just what is needed too clear what I call cobweb brain.... SO that we can continue on dealing n coping. No matter anything too keep on keeping on....... All information is good... We need all that we can get. We have too take care of our bodies n minds... Important to do with all that we are coping with.. so please do not feel bad at feeling that being at wits end.... drs are at wits end with me... day before started throwing up again.... and woke up crying yesterday morning n body vibrating..... n crying.... went into dr office.. nothing could be done fever being back again..... so drs talked on phone in front of me.. new script for infection again..... talking,,,,,,then telling boyfreind why this is so serious and why we got to get this under control.... we are working on... so hugss n lotzz of luvzzz dear Annie |

I live in Colorado and your right, their first offer is usually just that....an offer! My RSD was the result of a carpal tunnel surgery went bad, then the insurance company done a bunch of underhanded stuff like paying out of state lawyers to call me a liar, a hypocondriac ect. The finally gave me a total disability and were supposed to pay me every other week and pay my medical bills...well, I got paid like they contracted but every time the Dr ordered something they denyed it to the point I was getting worse...to make it short they kept up the bad faith untill they got busted. My settlement with the medicare setaside was almost a 1/2 million dollars, but remember they were trying to keep out of civil court and make me happy....I wanted to sue them for bad faith resulting in a worsening condition and three of their lying paid for Drs would have been on the very hot seat in a court room explaining why they falsified my records to keep me from getting the correct and timely medical treatment.....something they wanted to avoid at all costs. My case is not out of the ordenary, it is the ordinary for the criminal comp system in Colorado. Hi, It's cosmic mama again. Your story of battle with w/c was so encouraging a few weeks ago and I gained some personal strength that showed that there could be some mof us little people that can win against the bad boys. I need the name of your attorney, please. My rsd is result of cumulative trauma, carpal tunnel and tendenitist. 13 years on disability and here we go. Am emotional wreck, but have to get myself in order to meet with shrink, Gary Gutterman this March. Another w/c pi, quite possibly. At lest my attorney saaid he is one of the worst. Did you meet with him or another. ? My w/c, Pinnacol was probably your w/c in Co, right?How long was your battle? Should I not be ruined financially, and win my case, there would be a social security medicaree put asid for me if they offer a settlement.
Don't think that is going to be a possibility at this point, though. Do you get to draw for all medical or just w/c/related from this fund, and who does the record keeping for you. One day, I want to reach the people of this state with knowledge about this system that is supposed to help. Perhaps, ther is a way to organize our voices and experiences and keet our state reps to respond the way they do to insurance influence.. If it helped one person, it would be a victory, because one person might not lose their mind, relationships, and health. Help a girl, would you. Offer any info you might have, based on experience on what you feel is a battle plan. Thanks

Hi Cosmicmama, I can tell you a lot about work comp and comp lawyers. I recomend getting on SSD first before settling with w/c because you will need a medicare set aside...that is money that you get to pay your comp related bills with. The comp insurance company settles this with medicare what they figure your RSD treatment is going to cost. The way "my set aside works" is w/c put over 6 figures in the set aside but the money came to me, so actually is mine "but" I can only spend it on my RSD and a lower back injury I also recieved while at work. SO! lets say I spend all of the money and keep all the reciepts of the set aside money on my RSD, then medicare will pick it up from there less 20% that medicare always charges tha patient. That 20% really isnt much because medicare gets a heck of a discount and all you pay is the 20% of the discounted bill. OK, now here is what happens to the set aside money if there is any left when you die...it goes to who ever you will it to..it does not go back to the w/c company. A good lawyer will not let this go by, he will get medicare involved and get you on medicare and SSD first. Anyone in Colorado I would be happy to give this great work comp lawyer that won my case big time. He does not kiss ass with the insurance company but is their worst night mare if you are in the right! As you know work comp makes things harder than needs to be and they do it to make you go away...in my case they even went as far as to continually deny desperatly needed medical treatment....this cost them an "extra"1/4 million dollars" in settlement money, it was either that or a civil bad faith case.
