McDonald's sued over nude photos

A US couple is suing McDonald's for $3m (£2m) after nude photos of the woman, which were on her

husband's mobile phone, ended up on the internet.

Phillip Sherman says he accidentally left his phone, with the photos, at a McDonald's in Fayetteville, Arkansas. He says staff promised to secure the phone until he could retrieve it.  

The Shermans claim they had to move to a new home after the woman's name, address, and phone number appeared online along with the photos.

Tina Sherman says she began receiving offensive calls and text messages about the pictures from her husband's mobile phone after he left it at the McDonald's on 5 July.

The couple then discovered that the nude pictures she had sent to her husband's phone had been posted online.

The Shermans are suing McDonald's Corporation, the owner of the franchise involved and the restaurant's manager, saying they have suffered emotional distress, embarrassment and damage to their reputations.

They also allege loss of earnings and want to recover the cost of moving to a new home.

McDonald's Corp, the franchise owner and the manager have so far refused to comment on the case.

{Seems to me this couple got just what they deserved. If your going to put things like nude photo's of yourself on a cell phone you better not lose it! Why they think McDonald's is somehow responsible is beyond me. I heard this sort of thing was not uncommon with teenagers as well. Aren't they afraid their parents will see it?? Should cell phones have camera's in them? Can they be disabled? What do you think?}

Yeah - I saw that article on Oz news Rose. What do I think? The stupid clown deserves everything he gets! No sympathy here......personally I hope Maccas sue his arse for leaving porn in their family orientated premises!!! Har har har....!!

After all, some little five year old could have picked it up and lost his sight! Those little people can be pretty nifty when it comes to accessing data from mobile phones - they are actually better than me at operating one.

I actually have two "naked pictures" on my cell phone -- my dogs -- neither of which is wearing a stitch of clothing.  Anyone who wants to waste time putting them up on the web is free to do so.  Those are the only two photos.  But as I think about it, I may have way too much other more serious stuff on my phone, ranging from contact info to some relatively sensative personal and work-related messages.  And as often as I walk off and leave my phone somewhere (thankfully most everyone here in town just takes it in stride and calls me either at home or work to let me know where I've left it this time) I probably should clean it out.

As for myself... privacy is privacy. It is very unfortunate that the federal government hasn't written very strict laws against this type of behaviour from pranksters. It should be a felony to post nude photos on line with out permission and the posters should be put on the sexual predators list.

you are brilliant. that is exactly what McDonald's should do.

They should sue them for distributing porn on their premises.

this excessively litigious couple is dumb. real dumb.
