Hi I'm looking for a birth for John WELLING(S) he was born app 1816-1817 apparently in London the only info I have on this fella is his trial info JOHN WELLING age 20 birth place London sent to Australia on the ship Strathfieldsaye occupation footman/indoor servent convicted at the CCC 1836 of stealing also looking for birth of John's wife Amelia PEARSON also apparently born London  she was born app 1823 parents James & Eliza PEARSON James & Eliza arrived Australia app 1825 with Amelia any info appreciated

This is Kay and I will see if I can help you trace your Wellings/Pearson ancestors.
 
I've initially look for births of John in London around 1816-1817 and found the following - you will note the spelling of the surname, but this is not uncommon for names to be mistranscribed and/or altered through the years:

Going from there and because of the location (and the names of parents you have provided) I have found the birth record of Amelia:

Then, having searched for children of James Pearson & Eliza I found this record which I beleive to be that of Amelia's brother:

Hi Kay the surname for Eliza Pearson is Bourne and as far as we know Amelia's brother James was born in Australia in 1827 there is alot of confusion with the children of James & Eliza Pearson as they  arrived in Aus in 1825 and the kids were christened here (Aus) in 1828 some family trees have Amelia born here because of the christening place and some even have a different last name for her mum Eliza as for John Wellings his name has been spelt Welling Wellings Willings his trial notes and ticket of leave had no other info and death cert has no names mentioned for parents John is a real headache thanks for your help much appreciated

Well it rather sounds as though you already have more information than I've been able to find from this end.  I couldn't find a marriage for Eliza Bourne, for example.  Sorry I've not been any help on this one, but rest assured, if I should find anything for you I will post straight away.

Unfortunately Lee the only other birth record I can find in Greater London for John Welling is in 1811 - rather too early by the sounds of it.
 
Of course, there are various counties which abut Greater London, so of course it's just possible he could have been born "over the border" so to speak.

2285. JOHN WELLING was again indicted for stealing, on the 22nd of

October, at St. Giles's Camberwell, 1 till, value 2s.; 4 shillilngs and

2 sixpences; the goods and monies of George Mussell.

GEORGE MUSSELL . I live in Church-street, Camberwell. On the 22nd of

October, about half-past eight o'clock in the evening. I heard a noise

in the shop—I went in immediately, and found the till on the floor—I had

seen it about five minutes before—there was then five or six shillings

in it—nobody had been in the shop after I saw it safe, to my

knowledge—when I got into the shop I saw the prisoner outside the door,

collared by the witness—he struggled to get away—the money was in the

till, which was on the floor.

Cross-examined by MR. PAYNE. Q. How far were you from the persons who were

struggling? A. Close to them—I did not lay hold off the prisoner, as the

witness was sufficiently strong; but he got away—I did not feel inclined

to lay hold of him—I was standing at the door—I saw him for about two

minutes—I did not lose any money—I had never seen the prisoner before—I

was by his side—I do not recollect saying anything to him—I was much

agitated at the time—I can swear to him—there was a lamp-post immediately

opposite.

JAMES MAYES . I was standing close by the prosecutor's shop, at about

half-past eight o'clock in the evening, and saw a person go into the

shop—it was the prisoner, I am sure—I watched him, and saw him reach

over the counter, and take the till out—I stopped him at the door with

it—I took hold of him, and he made his escape—I have not the least doubt

of him, and swear positively he is the man.

Cross-examined. Q. Had you ever seen him before? A. No—I was walking with

a man, who is not here—he saw all this—I struggled with the prisoner for

about two minutes—the prosecutor came in the mean time—he did not attempt

to lay hold of him—I was close to the shop, looking in at the window—there

was a gas-light in the shop—I swear I distinctly saw his features—it

lasted about five minutes altogether—I did not follow him when he got

away.

Prisoner's Defence. I was going home, and the policeman came up to me, and

asked me to go back to the shop—I walked back with him—I know nothing of

it whatever—I had been to order some goods, which I had to take to a

lady's house.

GEORGE MUSELL . There was 10d. in the till besides the silver—a

policeman took the prisoner—he is not here.

GUILTY . Aged 20.�?Transported for Seven Years.

Mike suggested you might like to drop a line to The Old Bailey giving them details of the trial - as much as you can really - in the hope they may be able to shed some light on things for you.  All the relevant details when he was arrested would have been given to the Police.
