What do you think about the Appeals Court overturning the guilty verdict in the Andrea Yates case of the Texas woman who drowned her five children and finding her not guilty by reason of insanity?

I find it reprehensible what the jury did.  Irregardless of the fact she had post pardom depression this woman KNEW right from wrong.  Her call to 911 AFTER she drowned those innocent babies showed that.  And the fact she met them at the door, calmly explaining that she had drowned her children!  I realize shock can do alot to people but this woman DELIBERATLY KILLED her children! 
  I do not for one moment believe that her mental illness caused this, though it may have contributed.  But the fact that she took care to only commit this crime when her husband was NOT home shows me a clear mind capable of forming intent, and understanding the right or wrong of her intentions. Plus the fact that she was going to do it 2 months prior but changed her mind because her husband was home cements this for me.
    Apart from the horrendous nature of her crimes this woman now may someday be able to return to society, supposedly "cured", remarry,  and have more children! 
     My outrage when hearing this went deep into my soul!  I look at my grandchildren and just cannot imagine being able to do such a thing with such cold premeditation as this woman OBVIOUSLY did! 
    I hope this jury can sleep with the decision it has made......giving a cold blooded premeditated child murderer the chance someday at a completely free life.  What a horrible thing to unleash on society. 
    Shame on them!

Well, I read through all 19 pages of information on this case even though I remember it from when it happened, and I'm just as horrified today as I was then.  It is a horrible tradegy and loss of life that is beyond comprehension. 
 
I have worked with people who are mentally ill and it's scary.  It's scary to know that there are people out there with an illness that can cause them to do reprehensible acts and that there is nothing we as the general public can do to make it different.  I've seen people with Bi-Polar and Schizophrenia seem okay while taking their medication, only to stop taking the medication voluntarily becuause they feel all better and once again descend into the abyss of mental illness.  Do I think Ms. Yates is mentally ill?  Oh yeah.  Does that mean she should not pay for what she did?  No, I don't feel that way.  I don't believe though, that she will get out anytime soon, and if / when she is released she will most certainly still be a very sick person.  I don't think rehabilitation is possible for her.  I would like to see her locked away somewhere forever.  How does one rebound after something like this??  How does one ever block those images from the mind and go on to live a so called normal life?   I don't think it's possible and I don't believe she belongs in general society. 
 
Who knows what the jury was instructed to consider or not consider.  Now that I have been on jury duty and seen the jury instructions on 5 different cases I can say that it's not always black and white and sometimes decisions are made that don't sit well with other people.  Jury instructions change from case to case as different laws and charges are applied to them and it can be very confusing.  How could a juror not look at Yates and think she is insane.    Don't get me wrong, I don't like the decision either, I don't ever want her walking the streets!!!!!
 
I have a problem with the husband having no culpability in all of this.  He knew, HE KNEW she was a very sick person and yet he just went about his own life that day and didn't protect his children.  I feel that he is a very sick man as well, but he is scott free and walking the streets.  Ah well, I guess he has to live with himself and his decision every day for the rest of his life.

I'm afraid my opinion on these matters is rather direct and to the point. She called the cops and the hubby, so she knew what she had done, the calls were a "come see what I did" action.
The statement "I'm a bad mother , I deserve to be punished", is another indicator. Is she a whack job? Oh hell yeah, but to be left alive to live in a facility till she is deemed sane again.....nope sorry, a bullet would be the right move in my opinion. Save the tax payers the cost of living accomodations and save the surviving family members the pain of knowing she is still breathing, when the 5  she killed can't.
Just my opinion.

After working in law for so many years, I became immune to a number of things people did to one another... A person can actually get used to seeing pictures of people missing body parts or with their heads kicked in... trust me... BUT, the one thing I have NEVER been able to get used to is people hurting little people... I just simply can't bear it...
 
I agree with you Coco... the husband came out of this playing his role to the hilt... but he knew how sick she was and did nothing to insulate his children from harm... Instead he made a big deal of her being found guilty and thinking she was entitled to be found not guilty by reason of... He was equally so in my books...
 
I am also of the view that her medical doctors and psychiatrists had a responsibility to intensely examine this woman instead of giving her a bottle of pills and sending her home... Where was her family in all of this?  Where were the people in the community?  The school system MIGHT have picked up on this horror if the kids had had to attend the public school system (altho' so many have sat right under teachers' noses with their black eyes and nothing has been done...)
 
I try not to think of how those babies died and the horror the 7 year old must have experienced in his last minutes alive... It makes me sick to my stomach...
 
Post-partem depression and chemical imbalances are no excuse for one human being to do what this beast did to 4 helpless little people and I find it incredible that 12 people can so easily forget the terrible suffering of those babies... I have a problem with her still breathing to Top...
 
In cases like this, I believe she should at very least, be forced to stay imprisoned with perhaps a bathtub full of vomit and feces in her cell .. and maybe even a baby doll facedown in it so that she can't forget for one second what she did... And maybe, the jurors should get a dose of that too... And that stupid husband!!!

That woman is despicable. The husband, just as bad. He knew that she was ill, he knew she was prone to depression, he knew she was capable of this stuff, yet he brought 5 children into the world via her. Almost like giving a lion a gazelle and then getting angry with the lion for killing it.
Don't get me wrong tho, her acts are condemnable. She knew what she was doing. It's truly disgusting and it brings me back to when I was holding my new baby in my arms myself and reading those morning headlines in the newspaper.
I side with you guys, and all the points you have made. How very very unkind and unloving of her. She's a candidate for a hysterectomy and a lobotomy.

Well I sat here and read it all and found it quite interesting..I also found it quite pathetic that nobody in the medical field nor in this woman's family could see  or do anything to help her with her psychosis..Legally I understand how the courts need to be sure that she was deemed incompetant to stand trial if she was that sick after having her first child and kept getting sicker and more delusional after each baby she had..It makes one wonder what kind of treatment is out there for somebody that demented..
I know what it is like after having a child and having post partum depression and if it is not caught right away, it can manifest into something more serious for not only the mother but the child/children or even the family involved..So after reading about her husband indoctorinating himself and his little family into the preachings of a known fanatical prophet and listening to every word him and his wife told them to do..Makes me wonder what kind of husband he really is?...Then Andrea finally goes for help and is diagnosed by" more "than one psycholigist but nobody makes sure that she is on her medication.."NOT even her loving hubby"!!....Seen this one before to...Well known highschool teacher in our town that is diagnosed with Manic depression..just out of the blue goes on a week long spending spree,decides that every man that looks at her is not worthy and makes up a full documented list  of these men (that she apparently knows) and puts it up at the Mall for everyone to see..Penis size...how well they did her..EVERYTHING!!! Then very early in the morning she decided to clean and didn't stop until "my father -inlaw and his wife" went up to stop her, as she was vacumming her small bedroom for 2 hours and was keeping them awake..Ya know what happened?...She was taken down to the hospital and was given  medication and a prescription...Andddddd she refused!!!...Yup refused any sort of help...
Now back to this case...Yup...Andrea did the samething..took the prescription and never filled it...Most ppl like this will refuse any help as they figure in their little twisted minds that what they are doing is right..Example: Daughte's good friend was diagnosed with Bi-polar...she was put on medication for it...she got better...she went off it...right back to the way she was earlier...Had a child..went on ritalan...nope that made her worse...put her on somthing else...ok she was a teeny bit better...Boommmmm the shit hit the fan and she freaked out on her district manager at the photo studio in Walmart...Got fired and told to leave the store never to go back in there again...Went home and got into a fight with the girl that rents a room from her and her husband...Cops are called...Cops try to calm all of them down...She grabs a couch cushion off the couch and proceeds to throw it at one of the cops...They hand cuff her...She starts kicking and screaming and banging her head against things..(all the while her little girl is in the bedroom trying to sleep)..The Cops take her immediately to the hospital to get help(medical) The doctor shoots her up with a sedative and they keep her up in the psyc ward for the night the next morning she is released into her mother's care with "Strict" instructions that she stays on her medication...
So yah, hard sword to swallow..Who really knows what goes on in the mind of someone that mentally ill..All I do know is that this woman will not see the outside ever again..Maybe she'll be treated for the disease and will eventually come to terms with the horrific thing that she did..We can only interpret from what we read, voice how we feel..but until we have been there and done something about it...We shouldn't Judge!!!!!
