A employee of WalMart has a automobile accident causing her severe brain impairment and confined to a wheelchair. They sue the trucking firm and get one million dollars for her future medical, etc. WalMart insurance paid her medical and has a clause that if an employee sues and wins a lawsuit they must pay Walmart back the medical coverage they spent.  Read the link for more info......
 
Do you think they should make an exception in cases like this? Is it fair to do to anyone?

These ppl are having a tough enough time taking care of each other.I predict a LOT of Walmart boycotting,especially by the disabled.Boooo Hissss!

Considering the woman received a million dollar settlement, I think they should pay at least a portion of the Medical bill out of that.
Two years after the accident, Shank and her husband, Jim, were awarded about $1 million in a lawsuit against the trucking company involved in the crash. After legal fees were paid, $417,000 was placed in a trust to pay for Debbie Shank's long-term care
 
The couple has divorced so the wife can receive Public assistance.
It seems to me they must have "sheltered" a good portion of the settlement for her to qualify.
I say they should pay at least a portion so the premiums of the group aren't raised.
 
On another note... The news says due to her short term memory , she cries every time she hears her son was killed.  Why the Hell  are they telling her?

Out of the $417,000 only $277,000 is left. She will remain in the nursing home. WalMart made 90 billion dolars the third quarter of 2007. I think the clause they have stinks and should not be allowed.  That money won't last and she will be on total public assistant for the rest of her life.
 
On the other hand he divorced  her and mentions he won't be able to take care of her but since he divorced her wouldn't that make the state responsible? Theres some mixed comments for sure in there.

Walmart is not our insurer, they pay in toward our insurance which is Blue Cross.  I'm not sure but I think it is a fairly common stipulation with insurers and I don't see how they wouldn't have been informed well before they received the money.  What I find more disturbing is that after winning a settlement she is on public assistance...how does that work?  You would think she wouldn't be able to have any assets to qualify.  Well she is beyond worrying about it...poor soul.  Did you see her on TV?  So sad.

a million bucks sure doesn't go very far these days especially when the legal fees take more than half why didn't they go for more money or at the very least the cost of her care for the rest of her life? I am not up on this story but seems like this woman lost her whole life , her family, her physical  health what's left after that?

Bandy-  I agree, one million was not enough for what they took from her.  Her lawyer should feel bad for her and give them the money back for legal fees. That way he would be a good guy in all of this and show WalMart up......
